WELCOME TO JPC RENTALS

In consideration of the Jax Party Central LLC. permitting me (Customer) to take possession of and drive the vehicle described below, whether on a test drive, or as a temporary loaner, a rental or lease vehicle, I agree to the following terms and make the following representations which I assert are true and correct. 

1. I have a Valid and unrestricted Florida Driver's License and have provided Jax Party Central LLC., with a photocopy thereof. 
2. I currently maintain in full force and effect automobile liability insurance (bodily injury and property damage liability), and physical damage insurance (full comprehensive and collision damage coverage) pursuant to Florida's Statutory requirements with respect to my currently owned vehicle, and I have provided to Jax Party Central LLC., accurate information as to my insurance company, policy number and agent's name and telephone number.

NOTICE OF SHIFTING OF INSURANCE LIABILITY

        3. I understand, acknowledge and agree that pursuant to Florida Statute $627.7263:

(a) THE VALID AND COLLECTIBLE LIABILITY INSURANCE AND PERSONAL INJURY PROTECTION 

INSURANCE OF ANY AUTHORIZED RENTAL OR LEASING DRIVER IS PRIMARY FOR THE LIMITS OF LIABILITY AND PERSON INJURY PROTECTION COVERAGE REQUIRED BY $324.021(7) AND 627.736, FLORIDA STATUTES. 

(b) I am contractually incurring a liability by agreeing to shift primary liability for this vehicle to my insurance carrier while the vehicle is in my possession and control. 

(c) Once I have read and signed this Agreement, my automobile insurance becomes the primary liability insurance up to its full policy limits whether or not my insurance policy contains a provision prohibiting such shifting of insurance coverage.

1. I agree to and do hereby assume sole and complete responsibility and liability for any damage to the vehicle, and for any and all damages including property damage, bodily injury or death resulting form the operation or use of the vehicle while it is in my possession or under my control.
2. I agree to indemnify and hold Jax Party Central LLC., harmless and pay Jax Party Central LLC costs to defend any and all claims or damages, including property damage, bodily injury or death arising out of or relating to the operation and/or use of the vehicle while it is in my possession or under my control.  
3. IF THIS IS A TEST DRIVE, OR A TEMPORARY LOANER, RENTAL OR LEASE AGREEMENT:
   1. I have been given an opportunity to inspect the vehicle and note directly below any damage to the vehicle prior to taking possession thereof. If I fail or choose not to inspect the vehicle prior to entering into this Agreement, then I hereby knowingly, voluntarily and willingly waive my right to claim and/or assert as a defense that the damage existed prior to my taking possession of the vehicle.
   2. I will not use this vehicle negligently or in violation of any law or while under the influence of alcohol or drugs or in any unsafe manner. 
   3. I will not permit the vehicle to be driven by any other person unless otherwise agree to in writing by Jax Party Central LLC.
   4. The vehicle will not be driven beyond 200 mile max daily limit.
   5. I agree to pay all traffic and parking tickets issued by any enforcing authority while the vehicle is in my possession or control. 
   6. In the event of an accident, I agree to immediately advise Jax Party Central LLC., and to have a police report prepared at the scene, and provide all information about the accident to Jax Party Central LLC.
   7. I agree to return the vehicle on or before (Return Time) or, if no Return Time is noted, within 24 hours of taking possession of the vehicle, unless the Return Time is extended by Jax Party Central LLC. in Writing and signed by a Jax Party Central LLC., employee consent and permission to my use and possession of the vehicle is revoked, and any use or operation of the vehicle thereafter is unauthorized.
   8. Upon return of the vehicle, a Jax Party Central LLC., representative will inspect the vehicle for any damage or excess wear and tear and will document any such damage or excess wear and tear and the cost to repair such items and the diminution of value for the vehicle whereupon a copy of said document will be provided to me, and I agree to pay the estimated repair costs and diminution of value within 48 hours of my receipt of said document.
4. In the event that I have left another vehicle in Jax Party Central LLC., possession, I understand Jax Party Central LLC., is not liable and/or responsible for any theft, damage, or loss of vehicle. 
5. I knowingly, willingly, voluntarily and irrevocably waive any right to trial by jury on all issues so triable as to any and all claims and obligations based upon, arising out of or relating to this Agreement, including but not limited to the shifting of insurance coverage for the subject vehicle to my insurance carrier.
6. I have read and agreed to the terms and conditions contained within the front and back of this agreement.

* $500 refundable security deposit is required for all rentals.  Deposits are only paid via Card or Zelle.  Deposits will be refunded 1 to 5 BUSINESS DAYS from the day of returned rental pending verification and inspection.*

*NO SMOKING IN VEHICLES!!!! $150 CLEANING FEE WILL BE CHARGED FOR DETAILING.

*GAS MUST RETURNED ON THE SAME AMOUNT OR $50 WILL BE TAKEN FROM DEPOSIT.
